Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the EnvyAI mobile application ("App") you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms do not use the App. These Terms constitute a legally binding agreement between you and EnvyAI.

2. Description of Service

EnvyAI is an AI-powered skincare analysis application that provides:

• AI skin analysis and scoring from photos
• Personalized skincare routine recommendations
• Makeup shade matching
• AI-powered skincare consultation chat
• Skin progress tracking

3. Not Medical Advice

IMPORTANT: EnvyAI is for cosmetic and informational purposes only.

The App does not provide medical advice, diagnosis, or treatment. All content including skin analysis results, scores, product recommendations, and AI consultant responses are for general informational and cosmetic purposes only and should not be construed as professional medical advice.

Always consult a qualified dermatologist or healthcare provider for skin conditions, medical concerns, or before making changes to any medical treatment. If you have a serious skin condition seek professional medical attention. Do not delay seeking medical advice because of anything you read or see in EnvyAI.

4. Account Registration

You must create an account to use EnvyAI. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Be responsible for all activity that occurs under your account
• Be at least 13 years of age to create an account

5. Subscription and Billing

EnvyAI offers the following subscription tiers:

Subscriptions are billed monthly through your Apple App Store account. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your iPhone Settings under your Apple ID → Subscriptions → EnvyAI.

6. Refund Policy

All purchases are processed by Apple and are subject to Apple's refund policy. EnvyAI does not offer refunds for partial subscription periods. If you believe you are entitled to a refund please contact Apple directly at reportaproblem.apple.com.

7. Cancellation

You may cancel your subscription at any time through your iPhone Settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period you have paid for. Deleting the EnvyAI app does not cancel your subscription — you must cancel through your Apple ID settings.

8. Account Deletion

You may delete your account at any time from within the App under Profile → Settings → Delete Account. Account deletion permanently removes all your data from our servers. Account deletion does not automatically cancel your subscription — you must cancel separately through your Apple ID settings before deleting your account to avoid future charges.

9. User Content and Photos

By submitting photos to EnvyAI you grant us a limited license to process those photos using AI for the sole purpose of generating your skin analysis results. You retain full ownership of your photos. We do not sell your photos to third parties or use them for advertising. Photos are stored securely and deleted when you delete your account.

You represent that you have the right to submit any photos you upload and that doing so does not violate any third party rights.

10. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, hack, or compromise the App or its servers
• Submit photos of other people without their consent
• Use the App to harass, abuse, or harm others
• Attempt to circumvent subscription paywalls or access paid features without payment
• Use automated tools to access the App

11. Intellectual Property

All content in EnvyAI including but not limited to text, graphics, logos, icons, images, AI analysis outputs, and software is the property of EnvyAI and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. AI ANALYSIS RESULTS ARE GENERATED ALGORITHMICALLY AND MAY NOT BE ACCURATE. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY SKIN ANALYSIS, SHADE MATCH, OR PRODUCT RECOMMENDATION.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENVYAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless EnvyAI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third party rights.

15. Dispute Resolution and Arbitration

Any dispute arising from these Terms or your use of the App shall be resolved by binding individual arbitration under the American Arbitration Association rules, not in court. You waive your right to participate in class action lawsuits or class-wide arbitration. This arbitration agreement does not apply to claims for injunctive relief or intellectual property disputes.

16. Governing Law

These Terms are governed by the laws of the State of Virginia, United States, without regard to conflict of law principles.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.
